What Is Florida’s Wrongful Death Law?
The Florida Wrongful Death Act, outlined in Florida Statutes 768.16 through 768.26, establishes a state policy that aims to transfer the financial burden of a wrongful death from the deceased’s family to the liable party responsible for the death.
Only the personal representative of the victim’s estate is authorized to initiate a wrongful death lawsuit. This representative is either designated in the deceased’s will or appointed by a probate court in the absence of a named representative. If the personal representative can successfully demonstrate negligence by the accused party, any damages awarded are partly allocated to the deceased’s surviving family members and partly to the estate. Then, these funds are distributed according to the deceased’s will or under Florida law.
The term “surviving family members” includes the deceased’s spouse, children, and parents, along with any other relatives who depended financially on the deceased.
What Damages Can Surviving Family Recover After a Wrongful Death Case?
In the aftermath of a wrongful death, the surviving family members may face significant emotional and financial hardships. The legal system allows for the recovery of various forms of damages in a wrongful death case to compensate for these losses.
The following is an overview of the types of damages that may be available to surviving family members:
- Economic Damages: This includes lost wages, benefits, and the potential earnings the deceased could have reasonably been expected to earn in the future. Additionally, it can cover medical bills related to the deceased’s final illness or injury, as well as funeral and burial costs.
- Non-Economic Damages: These are used to compensate for the intangible losses that don’t have a specific monetary value but deeply affect the survivors. These can include the loss of companionship, guidance, and emotional support that the deceased provided.
- Loss of Inheritance: For what the deceased would likely have saved and left as part of the estate for the family members had they not died prematurely.
- Loss of Consortium: Losses related to the lost benefits of a family relationship due to the death, including affection, solace, and more, typically awarded to a surviving spouse or children.
The specific damages awarded can vary significantly based on the circumstances of the case and the financial and emotional impact on the family. Our legal team helps surviving family members understand what specific compensation they may be entitled to and can provide the necessary representation to ensure they receive full and fair compensation for their loss.
