The Tampa Tribune reported on September 14, 2010, that three Bay Area lawyers were sued by 1-800-Ask-Gary for critical blog posts against the referral hotline. According to the Tribune, the bloggers posted a list of law firms that receive referrals from “Ask Gary” and point out that the firms do not disclose their referral relationship with the hotline. The lawsuit claims the blog postings are advertisements for the bloggers’ own firms, the posts do not meet strict advertising requirements of the Florida Bar and ultimately use unfair and deceptive trade practices. The bloggers position is that the hotline is merely trying to squelch critics. The bloggers have hired a First Amendment attorney to defend the lawsuit.
