Motorcycle Accident Awarded $1.975 Million Settlement

When 40 year old Robert M. Gianguzzo was struck by a vehicle while riding his motorcycle, he was thrown roughly 25 feet through the air. When EMT’s arrived Gianguzzo said that he was having trouble breathing. Gianguzzo was transported to the nearest hospital where he was pronounced dead on arrival.

Mr. Joseph Presti age 83 was driving the vehicle which struck Gianguzzo’s motorcycle. The defendants listed in the lawsuit for wrongful death included Allstate insurance company, Federal Insurance and Chubb Insurance. A settlement was reached through a mediator and a personal injury lawyer. An agreement between the parties came to a total of $1.975 million.

Because a settlement was reached there was no need for a jury trial or further court involvement and this allowed no admittance of fault or liability, but provided the estate of Mr. Gianguzzo with financial freedom and some small justice and satisfaction in the case of his wrongful death due to this accident.

It is often found that while motorcycles are touted as dangerous vehicles most of the time the motorcycle and the motorcycle driver are not at fault.
