David Apa, an Attica prison guard was injured while riding his motorcycle in August of 2007. The cause of the accident was Dr. Barbara Radolinski who veered in front of his motorcycle in her vehicle. Apa lost his job at Attica because of surgeries required due to the accident because he was not covered by a state disability or regular pension plan. The severe legs, pelvic, shoulder and back injuries that Apa experienced were the fault of the good Dr. and her negligence to share the road with a motorcycle rider.

On the evening before a negligence trial was to begin a settlement was reached between the personal injury lawyer and others involved and the out of work prison guard David Apa has agreed to accept $4.95 million for his suffering and loss of income due to the accident.
