Robert Reaser passed away in 2008. His wife and children have been fighting in the legal arena ever since to allege that Mr. Reaser’s previous employers had exposed him to deadly asbestos throughout the 1950’s, 60’s and early 70’s. At his retirement Mr. Reaser was diagnosed with mesothelioma. Mesothelioma is a slow growing deadly cancer that is caused by exposure to asbestos.
Mr. and Mrs. Reaser filed a personal injury action and los of consortium in Superior Court against 6 defendants who manufactures asbestos. This action was removed to Federal Court and is pending. Mr. and Mrs. Reaser also filed a personal injury action against more than 46 defendants alleging the same exposure history, and achieved no satisfaction. Mr. Reaser passed away and his family and estate have continued to fight for justice.
The case now pending against A.W. Chesterton and several other defendants is not only personal injury but now includes wrongful death. The only complaint and reasons that the defendants have brought before the court are related to jurisdiction and location. Several defendants have sought to have the case dismissed.
Mesothelioma is a cancer that is known to be caused by exposure to asbestos, that grows slowly over the years and often is not diagnosed until as many as 30 years after exposure, and also often found too late to offer a good prognosis. The similarity of many of the symptoms to common illnesses means that it does not get diagnosed until it is in the late stages.
